Terms of Service

These terms apply to website design, development, hosting and related services provided by Ayr Web ("we", "us") to business clients ("you", "the client"). By engaging our services or using this website, you agree to these terms. Project-specific agreements or quotes may add further detail; if there is a conflict, the signed quote or contract prevails.
Our services
We provide professional web design, development, hosting, maintenance and support. The scope, deliverables and timescales for each project will be set out in a quote or written agreement.
Quotes and payment
Quotes are valid for the period stated on the quote (or 30 days if not specified). Unless agreed otherwise, we may require a deposit before work begins and further payments at agreed milestones. Invoices are payable within the period stated on the invoice (typically 14 days). Late payment may pause work or incur interest in line with applicable law.
Your responsibilities
You agree to:
- Provide accurate information, content and approvals in a timely manner
- Ensure you have rights to any text, images, logos or other materials you supply
- Maintain backups of your own content where appropriate
- Use the website and services lawfully
Intellectual property
Until all agreed fees are paid, we retain ownership of custom design and code we create. On full payment, we grant you a licence to use the deliverables for your business as intended, subject to any third-party licences (fonts, plugins, stock assets, etc.). We may showcase completed work in our portfolio unless you request otherwise in writing before launch.
We retain ownership of our pre-existing tools, frameworks and know-how.
Hosting and uptime
Where we provide hosting, we aim for 99% uptime excluding planned maintenance (we will try to give reasonable notice) and events outside our reasonable control. Hosting fees are typically charged annually (commonly in the £80–£200 per year range depending on traffic and requirements, as quoted for your site). Renewal terms will be stated in your quote or hosting agreement.
Support and changes
Work outside the agreed scope may be quoted separately. We are not responsible for issues caused by third-party services, client-side changes, or failure to apply security updates where you manage the site yourself.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect or consequential loss (including loss of profit, revenue or data). Our total liability for any claim relating to a project is limited to the fees paid by you for that project in the twelve months before the claim, except where liability cannot be limited by law (including death or personal injury caused by negligence, or fraud).
We do not guarantee specific search engine rankings or business results from a website.
Cancellation
Either party may terminate a project in accordance with the project agreement. Deposits and work completed up to the termination date remain payable. Pre-purchased hosting may be refundable only as stated in your hosting terms.
Website use
You must not misuse this website (e.g. attempt unauthorised access, introduce malware, or scrape content in breach of law). Content on this site is for general information and is not legal or professional advice.
Governing law
These terms are governed by the laws of Scotland. Disputes are subject to the exclusive jurisdiction of the Scottish courts, without prejudice to mandatory consumer rights where you act as a consumer.
